NEMT Insurance typically refers to minimum requirements for commercial auto insurance to first meet state or federal mandated minimums for transporting passengers and then to meet the real world requirements of NEMT brokers who typically require much more than state minimum liability coverage to work for them.

For-Hire Versus Private Carriers

Any time a passenger carrier receives compensation for transporting passengers, it is considered for-hire. Unless subject to an exemption, all for-hire passenger carriers in interstate commerce must:
•Obtain FMCSA operating authority registration (no matter how small or light the vehicles used);
•Obtain and file minimum levels of financial responsibility (insurance): $1.5 million for operating vehicles of 15 or fewer passengers including the driver; $5 million for operating vehicles of 16 or more passengers including the driver; and
•Designate a process agent, a representative that can be served with court papers in any legal proceeding brought against a motor carrier.

Tips for For-Hire Status
•A not-for-profit organization can be a for-hire passenger carrier if the organization receives compensation.
•For-hire does not require the transportation to be available to the public.
•If a trip includes both private passengers and passengers providing compensation, it is a for-hire trip.

•Medical Transportation providers such as wheelchair van transportation services
•Non-Emergency Medical Transportation (NEMT’s) providers such as rides to medical appointments
•Emergency Transportation providers such as ambulance services
•ParaTransit is acceptable
•Volunteer ambulance companies are acceptable

Examples: Ambulances, rescue squad vehicles, non-emergency medical transportation autos, medical provider courtesy vehicles and others.

Financial Responsibility

The required level of financial responsibility (insurance or other acceptable security) for for-hire, interstate passenger transportation is determined by the highest seating capacity of your vehicles. Vehicles with a seating capacity of 15 or fewer passengers (including the driver) require $1.5 million of coverage, and $5 million is required for vehicles with a seating capacity of 16 or more passengers (including the driver).

So you are thinking of working for NEMT Brokers? If you are a new startup this could be a costly endeavor as they require many additional coverage’s that the typical NEMT companies may not ever need such as:

a. General Liability coverage of at least $1,000,000 (broad form and occur-made policy)
i. Abuse and Molestation coverage of at least $1,000,000 coverage per occurrence
1. We also accept the following sentence to be listed under the description of operations section:
a. “The General Liability policy contains no exclusions or sublimit for Abuse or Molestation coverage.”
b. Automobile liability of at least $500,000 (symbols 1 or symbols 2, 8 & 9 – symbol 7 is not acceptable) most companies issue as symbol 7, specifically described or listed vehicle/s.
c. Additional Insured status is required and adds more cost to your insurance in respect to general liability & automobile liability.”
d. Worker’s Compensation coverage – If you require this coverage, please provide a certificate of insurance that list this coverage.
